This Privacy Notice explains how we collect, use, store, and share your personal information when you use the OrbytHome platform (website, mobile application, and related services). This notice is issued in compliance with the Nigeria Data Protection Act, 2023 (NDPA) and the Nigeria Data Protection Commission's General Application and Implementation Directive (GAID), 2025, which together constitute the governing data protection framework in Nigeria.

We collect the following categories of personal data: Account Information: Name, email address, phone number, password (encrypted), profile photo, and role (buyer, agent, or admin). Property Listing Data: Property details, photos, location data, pricing, and descriptions submitted by agents and property owners. Payment Information: Bank transfer receipts, depositor name, bank reference numbers, and payment dates submitted for subscription verification. We do not store bank account numbers or card details. Usage Data: Pages visited, search queries, property views, interaction history, IP address, browser type, device information, and session duration. Location Data: City, state, and approximate location derived from your searches or property listings. Communications: Inquiries, tour requests, reviews, and messages exchanged through the platform.
We process your personal data for the following purposes: • To create and manage your account. • To display and manage property listings. • To facilitate communication between buyers, renters, and agents. • To process and verify subscription payments. • To provide property search, saved searches, and personalized recommendations. • To send transactional notifications (account verification, tour confirmations, payment status). • To improve platform functionality, performance, and user experience. • To detect and prevent fraud, abuse, and security threats. • To comply with legal obligations under Nigerian law.
We process your personal data based on the following legal grounds: Consent: When you register an account, submit listings, or upload payment receipts. Contractual Necessity: To provide services you have requested (property search, subscriptions, agent connections). Legitimate Interest: To improve our platform, prevent fraud, and ensure security. Legal Obligation: To comply with Nigerian laws and regulations, including tax and anti-money laundering requirements.
We may share your personal data with: Service Providers: Cloud hosting (Amazon Web Services), email delivery services, and analytics providers who process data on our behalf under strict data processing agreements. Other Users: Your name, phone number, and listing details are visible to other users when you list a property or make an inquiry. Agent profiles are publicly visible. Law Enforcement: When required by law, court order, or to protect the rights, property, or safety of OrbytHome, our users, or the public. We do not sell your personal data to third parties.
Your data is stored on secure servers hosted by Amazon Web Services (AWS) in the Africa (Cape Town) region. We implement appropriate technical and organizational measures to protect your data, including: • Encryption of data in transit (TLS/SSL) and at rest. • Secure password hashing using industry-standard algorithms. • Access controls and role-based permissions. • Regular security audits and vulnerability assessments. Despite our efforts, no method of electronic transmission or storage is 100% secure. We encourage you to use strong passwords and protect your account credentials.
We retain your personal data for as long as your account is active or as needed to provide our services. Specifically: • Account data is retained until you delete your account. • Property listings are retained for 12 months after expiry or removal. • Payment records are retained for 7 years to comply with Nigerian tax regulations. • Usage logs are retained for 24 months for analytics and security purposes. Upon account deletion, your personal data will be anonymized or securely deleted within 90 days, except where retention is required by law.
Under the NDPA, you have the following rights: Right of Access: Request a copy of the personal data we hold about you. Right to Rectification: Request correction of inaccurate or incomplete data. Right to Erasure: Request deletion of your personal data, subject to legal retention requirements. Right to Data Portability: Receive your data in a structured, machine-readable format. Right to Object: Object to processing of your data for direct marketing or profiling. Right to Withdraw Consent: Withdraw your consent at any time (this does not affect prior lawful processing). We use cookies and similar technologies to: • Keep you signed in across sessions. • Remember your preferences (saved searches, display settings). • Analyze platform usage and performance. • Deliver relevant content and recommendations. In line with the NDPC's GAID, non-essential cookies and tracking technologies are used only with your opt-in consent, which you may withdraw at any time. Essential cookies required for security, stability, and core functionality (such as keeping you signed in) do not require consent. You can also manage cookies through your browser settings; disabling them may limit certain platform features.
If a personal data breach occurs that is likely to result in a high risk to your rights and freedoms, we will notify the Nigeria Data Protection Commission within 72 hours of becoming aware of the breach, and we will inform affected users without undue delay, including clear guidance on protective steps you can take.
Our platform may contain links to third-party websites or services. We are not responsible for the privacy practices of these external sites. We encourage you to review their privacy policies before providing any personal information.
OrbytHome is not intended for individuals under the age of 18. We do not knowingly collect personal data from children. If we become aware that we have collected data from a minor, we will take steps to delete it promptly.
Your data is primarily stored in the AWS Africa (Cape Town) region in South Africa, and may be processed in other countries where our service providers (such as email delivery providers) operate. These are cross-border transfers under the NDPA. We ensure appropriate safeguards are in place, including data processing agreements and transfer mechanisms consistent with Section 41 of the NDPA and NDPC guidance on cross-border data transfers.
We may update this Privacy Notice from time to time. Changes will be posted on this page with an updated "Last Modified" date. We will notify registered users of material changes via email. Your continued use of the platform after changes constitutes acceptance of the updated notice.
