By accessing or using the OrbytHome platform (website, mobile application, and related services), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with any part of these terms, you must discontinue use of the platform immediately.
You must be at least 18 years of age and have the legal capacity to enter into binding agreements under Nigerian law to use OrbytHome. By registering an account, you represent and warrant that you meet these requirements.
To access certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at info@orbythome.com if you suspect unauthorized use of your account.
Agents and property owners who list properties on OrbytHome represent and warrant that: • They have the legal right to sell, rent, or advertise the property. • All listing information (price, location, features, images) is accurate and not misleading. • Listings comply with all applicable Nigerian laws and regulations. OrbytHome reserves the right to remove any listing that violates these terms, is reported as fraudulent, or is otherwise deemed inappropriate. IMPORTANT — LISTINGS ARE NOT VERIFIED BY ORBYTHOME. All listings are created and supplied by third-party agents and property owners. OrbytHome does not inspect properties, verify title documents, confirm ownership, or validate the accuracy of any listing information. Any "verified" badge or similar indicator refers only to identity or document checks on the account holder and is not a warranty, endorsement, or guarantee of any property, title, or transaction. Administrative review or approval of a listing before publication is a content-moderation step only and does not constitute verification of the property or its ownership.
Real estate fraud, including fake listings, impersonation of agents, and advance-fee ("rent scam") schemes, exists in the Nigerian market. You agree that before paying any money or signing any agreement you will: • Physically inspect the property and confirm the identity of the agent or owner. • Independently verify title documents (e.g., Certificate of Occupancy, Deed of Assignment, Governor's Consent) through a licensed legal practitioner or the relevant land registry. • Confirm, where applicable, that an agent is registered with the relevant regulatory authority (e.g., LASRERA in Lagos State or ESVARBON for estate surveyors and valuers). ORBYTHOME NEVER COLLECTS RENT, DEPOSITS, OR PROPERTY PAYMENTS ON BEHALF OF AGENTS OR OWNERS. The only payments made to OrbytHome are subscription fees for listing services. Never transfer money for a property to any account claiming to be OrbytHome. You acknowledge that you rely on any listing at your own risk and that OrbytHome shall not be liable for losses arising from your failure to conduct independent verification.
OrbytHome offers subscription plans (Starter, Professional, Business, and Premium) with varying listing limits and features. Paid subscriptions require manual bank transfer to our designated First Bank account. Subscriptions are activated after payment verification by our admin team. Subscription fees are non-refundable once the subscription period has been activated, except where required by applicable law.
You agree not to: • Post false, misleading, or fraudulent property listings. • Impersonate another person, agent, or entity. • Use the platform for money laundering, advance-fee fraud, or any illegal activity. • Scrape, harvest, or collect data from the platform without written authorization. • Attempt to gain unauthorized access to other users' accounts or our systems. • Upload content that is defamatory, obscene, or violates the rights of any third party. • Interfere with or disrupt the platform's operation or security.
All content on OrbytHome — including the logo, design, text, graphics, and software — is the property of OrbytHome Technology Ltd or its licensors and is protected by Nigerian copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.
By uploading photos, descriptions, reviews, or other content to OrbytHome, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content on the platform. You retain ownership of your content but are responsible for ensuring it does not infringe on any third-party rights.
Agents using OrbytHome must hold valid registration or licensing as required by Nigerian real estate regulations, including (where applicable) registration with the Lagos State Real Estate Regulatory Authority (LASRERA) for practice in Lagos State, and the Estate Surveyors and Valuers Registration Board of Nigeria (ESVARBON) under the Estate Surveyors and Valuers (Registration, Etc.) Act. Agents are solely responsible for the accuracy of their listings, their interactions with buyers/renters, their fees and commissions, and compliance with all applicable laws. Agents represent that they will not charge fees exceeding limits imposed by applicable state law.
OrbytHome is a marketplace platform that connects buyers, renters, sellers, and agents. We do not participate in, guarantee, or mediate property transactions. All negotiations, agreements, and transactions are solely between the parties involved. OrbytHome is not liable for any disputes, losses, or damages arising from property transactions conducted through the platform.
To the maximum extent permitted by Nigerian law, OrbytHome Technology Ltd, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform. Our total liability to you for any claim arising from these terms shall not exceed the amount you paid to OrbytHome in the twelve (12) months preceding the claim.
The platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy, completeness, or reliability of any property listings or user-generated content on the platform.
You agree to indemnify, defend, and hold harmless OrbytHome Technology Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the platform; (b) any listing, content, or information you submit; (c) your violation of these Terms of Use or of any applicable law or regulation; (d) your violation of any third-party right, including intellectual property, privacy, or property rights; or (e) any transaction, dispute, or dealing between you and another user, agent, buyer, seller, landlord, or tenant.
Your use of OrbytHome is also governed by our Privacy Notice. We collect and process personal data in accordance with the Nigeria Data Protection Act, 2023 (NDPA), the NDPC General Application and Implementation Directive (GAID) 2025, and other applicable data protection laws, as described in our Privacy Notice.
We may suspend or terminate your account at our sole discretion, without prior notice, if you violate these Terms of Use or engage in conduct that we determine is harmful to the platform or other users. Upon termination, your right to use the platform ceases immediately, but provisions that by their nature should survive (including limitation of liability and dispute resolution) will remain in effect.
Any dispute arising from or relating to these Terms of Use shall first be resolved through good-faith negotiation. If the dispute cannot be resolved amicably within 30 days, it shall be referred to mediation and, failing settlement, to arbitration by a sole arbitrator in Abuja, FCT, in accordance with the Arbitration and Mediation Act, 2023. The arbitration shall be conducted in English, and the decision of the arbitrator shall be final and binding. To the extent permitted by law, disputes shall be resolved on an individual basis, and neither party shall bring or participate in any class or representative action against the other.
These Terms of Use shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. You agree to submit to the exclusive jurisdiction of the courts located in Abuja, FCT, Nigeria.
OrbytHome reserves the right to update or modify these Terms of Use at any time. Changes will be posted on this page with an updated "Last Modified" date. Your continued use of the platform after any changes constitutes acceptance of the revised terms.
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Entire Agreement: These Terms, together with the Privacy Notice and any listing or subscription agreements, constitute the entire agreement between you and OrbytHome regarding the platform. No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision. Assignment: You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights in connection with a merger, acquisition, or sale of assets. Force Majeure: OrbytHome shall not be liable for any failure or delay caused by events beyond its reasonable control, including internet or power outages, government action, civil unrest, or natural disasters.
